MA Paid Family & Medical Leave (MAPFML)
All private employers with employees working in MA are eligible to participate. The law covers all employers, 1 or more, and includes 1099 employees. Employees are eligible if they have worked 15 weeks or more, and have earned at least $4,700 in the preceding 12 month period, no amount of employer service is required. MA requires employers to fund the program by paying .75% of the social security wage limit directly to the at the end of each quarter. The payment consists of both an employer and employee contribution.
The total aggregate time an employee can take between medical and family leave is 26 weeks in one calendar year. The maximum weekly benefit is 64% of the MA average wage, which is recalculated annually.
Under MA law, employers can opt our of the MA state plan for a private plan at the beginning of a quarter. The private plan must contain the same or more favorable benefits than the state plan. The Two River Benefits private plan exceeds the MA state benefits while reducing the employer contribution- saving the employer money. For the employee claims payments are made with 10 business days, far faster than the MA state plan.
